1. Agreement to these terms
Welcome to awuradenayeboreholes.com (the "website"). The website is owned and operated by Awurade Na Aye Borehole Company ("we", "our", "us"), a company carrying on business in Ghana under the Companies Act, 2019 (Act 992).
By browsing, interacting with, or requesting a quote through the website you accept these Terms of Use. If you do not accept them, please stop using the website.
2. What the website is for
The website provides information about our services - borehole drilling, water treatment, pump servicing, swimming pool construction, and hydro fracturing and geological investigation - and lets prospective customers send us a quote request. Use of the website is free.
Signing a formal contract with us for any actual works is separate from accepting these Terms of Use. The scope, pricing, warranty, and deliverables of any job are governed by the service agreement you sign with us.
3. Who may use the website
You must be at least 18 years old, or using the website with the permission and under the supervision of a parent or legal guardian, to submit a quote request. We may ask for age verification where it is reasonable to do so, and may decline to act on a request where we are not satisfied.
4. Acceptable use
When you use the website you agree not to:
- submit false, misleading, defamatory, or abusive content through our forms;
- attempt to gain unauthorised access to any part of the website, our servers, or the mailbox that receives quote requests;
- use the website to transmit viruses, spam, or any malicious code;
- scrape, reverse-engineer, copy, or redistribute any material on the website except as allowed by applicable law;
- impersonate another person or misrepresent your relationship with any company or institution;
- use the website for any purpose that is unlawful under Ghanaian law or harmful to other users or the public.
5. Availability and changes
We work to keep the website online and current, but we do not guarantee uninterrupted availability. We may update content, add or remove features, restructure pages, or schedule downtime for maintenance without prior notice.
Prices, timelines, and specifications shown on the website are indicative only. Only a written quote issued by us is binding. A quote request submitted through the form is an invitation for us to reply with an offer; it does not create a contract by itself.
6. Intellectual property
All text, images, videos, logos, trademarks, and design elements on the website are owned by or licensed to Awurade Na Aye Borehole Company. You may view and download pages for personal, non-commercial reference (for example, to share a quote enquiry with your household or business partners). You may not copy, republish, or adapt any part of the website for commercial purposes without our prior written permission.
The "Awurade Na Aye" name and logo are trademarks of the company. All other trademarks shown on the site belong to their respective owners.

8. Disclaimers

Information on the website about drilling depths, yields, tariffs, timelines, and service regions is indicative; actual outcomes depend on site conditions, geology, and other factors we will discuss with you directly.
9. Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, consequential, or special damages arising from your use of - or inability to use - the website, including loss of profits, loss of data, or business interruption. Our total liability arising out of the website (but not our service contracts) is limited to GHS 500, or the minimum allowed by law, whichever is higher.
Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud, where such limits are prohibited by Ghanaian law.
10. Suspension and termination
We may remove content, block access, or suspend or terminate your use of the website at any time if we have reasonable grounds to believe you are in breach of these terms, where required by law, or to protect other users. Where possible we will explain why; in urgent cases we may act first and inform you afterwards.
11. Privacy
Your use of the website is also subject to our Privacy Policy, Data Protection Statement, and Cookies Policy. By using the website you agree to how we handle your information as described in those documents.
12. Governing law and jurisdiction
These Terms of Use and any dispute arising from the use of the website are governed by the laws of the Republic of Ghana. You agree to submit to the exclusive jurisdiction of the courts of Accra, Ghana, for any matter that cannot be resolved amicably.

We may amend these Terms of Use from time to time. When we do, we update the "Effective date" at the top of this page. Continued use of the website after a change means you accept the updated terms. For significant changes we will post a notice on the site for a reasonable period.
